Oregon Gun Control Measure 114 Remains Blocked in FPC-Supported Appeal

SALEM, OR (April 15, 2024) – Firearms Policy Coalition (FPC) announced today that the Oregon Court of Appeals ruled against the State in a Friday decision, maintaining the injunction against gun control Measure 114. As a result, the State cannot enforce the unconstitutional laws enacted under the measure while the appeal is pending. The order can be viewed at FPCLegal.org.

“[G]iven that the ‘stay’ would change the existing state of affairs and that the state has not shown that it is overwhelmingly likely to obtain a reversal of the judgment, the court is not persuaded that the state’s likelihood of success supports allowing Measure 114 to go into effect while this appeal is pending in the face of the trial court’s determination that the measure is unconstitutional,” wrote the Court is its Order.

“The Court properly denied Oregon’s frivolous attempt to force Measure 114 into effect,” said FPC founder and President, Brandon Combs. “FPC will continue to aggressively support this and other efforts to eliminate unconstitutional laws in Oregon and throughout the United States.”

“We are gratified that the Court of Appeals preserved the trial court’s injunction while we litigate federal constitutional challenges to Oregon’s Measure 114 in our Fitz v. Rosenblum and Azzopardi v. Rosenblum cases,” said FPC Action Foundation President Cody J.
