WILMINGTON, Del. (March 25, 2024) – Today, Firearms Policy Coalition (FPC) announced the filing of a motion for summary judgment in its lawsuit challenging Delaware’s confiscatory ban on all unserialized, self-manufactured firearms, items and materials that may be used to self-manufacture constitutionally protected arms, and the distribution of any files that may be used to program a 3D printer to produce a firearm. The brief in Rigby v. Jennings, along with the partial preliminary injunction that FPC previously secured, can be viewed at FPCLegal.org.
“The possession and use of [non-firearm objects] to self-manufacture is certainly nothing new,” argues the motion. “In fact, they have been commonly possessed and used by law-abiding citizens for such purposes, including the self-manufacture of arms for self-defense, throughout American history. Manufacturing of firearms was not just common, but was entirely unregulated during our Colonial and Founding Eras, and there were no restrictions on who could be a gunsmith or manufacture arms.”
“Delaware’s near-complete ban on the self-manufacture of firearms–and items that can be used for self-manufacture–is blatantly unconstitutional,” said Cody J. Wisniewski, FPCAF’s President and Chief Executive Officer, and counsel for FPC. “Delaware simply cannot meet its burden of proof to support its modern gun control law under Bruen, and thus, it should be struck down and the state should be permanently prevented from enforcing it.”
Plaintiffs in this case are two individual FPC members and FPC.
