In today’s FPC legal update, we have updates in cases from Nevada and New Jersey.


Green v. KCI

Issue: Liability

Action: Complaint

Calling them “instruments of slaughter,” the plaintiffs in this new lawsuit claim that KCI should be liable for selling 100-round magazines, one of which was used in a shooting in Dayton, Ohio. Calling them “large-capacity magazines,” or LCMs, the lawsuit claims that “[t]he people in the civilian market who need LCMs are mass killers” and cites a man who wrote a letter to the editor in a local Michigan newspaper in 2017 to bolster its argument. The defendants will now have an opportunity to respond to the complaint.


Smith & Wesson v. Bruck

Issue: Advertising

Court: District of New Jersey

Action: Opinion

In this lawsuit, Smith & Wesson is suing New Jersey after the company was told to turn over records related to its advertising in the state. A federal judge dismissed the lawsuit today, saying that because there is an ongoing lawsuit in state court, the federal court should not step into this matter yet. The lawsuit will now continue in state court, and it’s possible that this case could return to federal court once those proceedings conclude.
