FPC: U.S. Senate Must Confirm a Strong Constitutionalist Justice NOW

(September 19, 2020) Since McDonald v. City of Chicago, the Supreme Court has time and time again shown us that Americans who value liberty and freedom need a strong Court majority with the courage to take on important cases and issue decisions consistent with the text of the Constitution. By refusing to grant certiorari on key petitions and issue clear and strong decisions that compel lower courts to respect the full text of our national charter, the Court has shirked its duty to oblige the government to control itself.

Our American system of ordered liberty cannot and will not survive if the judiciary continues to shirk its responsibility and purpose of being a check against the legislative and executive forces that it has too long deferred to, allowing the coordinate branches to aggregate power and brazenly act outside of constitutional constraints. The Third Branch of government is not a lesser one, and the Supreme Court has a constitutional duty to enforce the Constitution, not their personal views or even prior wrongly decided precedents they may find themselves emotionally tethered to out of a misguided paternalism that rationalizes away the dangerousness of inaction and soothes itself with notions of reliance interests.

The American people deserve a strong Supreme Court majority who will do what the Constitution’s text and liberty compel. And that is why President Donald Trump must ensure that the next Supreme Court justice has a deep moral obligation to aggressively and unwaveringly defend the Constitution and our liberty in every instance through strict adherence to the text itself, even and especially when the government must lose accordingly.

Firearms Policy Coalition calls on President Trump to quickly nominate a strong, courageous, and principled jurist who will vote without hesitation to vigorously protect fundamental rights, including the right to bear arms and freedom of speech, and restore the Constitution’s limits on government. FPC further calls on Senate Leader McConnell and members of the Senate to quickly confirm such a nominee without delay.
